Court attendance. Although short notice requests will be accommodated wherever possible, a non-returnable retainer will be charged once dates are agreed and accepted. I reserve the right to charge up to 2 days Court appearance fees whether or not the hearing takes place as planned.

It is my experience that an Expert Witness is expected to attend upon Counsel and the instructing Solicitors at hours outside those observed by the Court. I therefore charge appearance on a daily basis, with a minimum of half a day's appearance on each day of the hearing. These charges include being available outside Court hours as may be necessary.

Expenses will be charged in addition at cost. In the event of a hearing being re-scheduled or aborted, every effort will be made to reschedule work so as to avoid making charges on connection with those dates. If a hearing is re-scheduled, no additional retainer will be required, but at least one day's Court appearance fee will be charged if it too is re-scheduled.

Accounts will normally be rendered to the instructing Solicitor, unless instructed otherwise in writing.

Payment of an account rendered is due within one month of the date of it's issue. Failure to pay within this time will attract a charge of 10% per month on the outstanding balance.

Whilst charged rates have to be reviewed periodically, I undertake to maintain the quoted rates on a particular case for a period of 12 months.

Force Majeure. Neither party shall be held to be liable in any way for failure or delay in performing their obligations if such failure or delay is due to causes outside reasonable control.

Applicable Law. All work performed is subject to and should be constructed in accordance with English Law.
